В ВР зарегистрирован проект закона, предложенный нардепом Анатолием Гриценко №5066 от 12.02.2010 «О внесении изменений к некоторым законам Украины относительно отмены государственного технического осмотра транспортных средств».
Народный избранник выступает с инициативой отменить техосмотр как таковой. Стоит отметить, что это уже не первая попытка именно этого чиновника избавить автомобилистов от этого хлопотного и дорогостоящего обязательства. Летом 2009 предложение об отмене техосмотра было отклонено парламентом, хотя и привлекло немало внимания общественности. Вероятно, автор законопроекта надеется на то, что изменение политической ситуации в стране сейчас по-другому скажется и на восприятии документа.
Напомним, что проектом закона предлагается полностью отменить необходимость прохождения техосмотра автомобилей, зарегистрированных на физическое лицо. Обязательность осуществления проверки технического состояния транспорта на СТО остается лишь для специализированных автомобилей и тех, которые используются в коммерческих целях. Также инициативой предусмотрено отмена бюрократической процедуры подачи в ГАИ документов, свидетельствующих о наличии полиса обязательного страхования, внесения обязательных платежей, оплаты штрафов и прохождения медицинского осмотра.
Вполне возможно, что отмена техосмотра сильно облегчили бы жизнь простому автомобилисту, однако и заметно увеличили бы на автодорогах страны количество неисправного и опасного для жизни транспорта, нездоровых или неадекватных водителей. Однако, и тут «находчивый» и «предусмотрительный» депутат ссылается на уже действующее законодательство. Так, ст. 16 ЗУ «О дорожном движении» предусматривает, что полис обязательного страхования водитель должен иметь при себе постоянно, а требования к состоянию здоровья водителей определяются ст. 15 вышеназванного закона. Систематический медицинский осмотр предусмотрен соответственно ч. 2 ст. 12 ЗУ «О дорожном движении» и ч. 1 ст. 18 ЗУ «Об автомобильном транспорте».
По его мнению: «Государственный технический осмотр автотранспорта – это поборы, унижения и сплошной обман. Эта процедура не имеет ничего общего с безопасностью дорожного движения». К тому же, в странах Европы процедура техосмотра давно уже упрощена: владельцу автомобиля достаточно лишь воспользоваться услугами лицензированной мастерской, что забирает, как правило, не больше часа личного времени. Во многих штатах США об обязательном техосмотре даже не слышали, там происходит лишь проверка выброса вредных веществ.
Народный депутат Анатолий Гриценко (фракция НУНС): «Этот законопроект касается 9 миллионов наших граждан, с одной стороны, и затрагиваются интересы 10000 офицеров ГАИ – с другой стороны. Техосмотр в нынешнем состоянии — это общенациональная коррупция, все это знают. Все признают, что это поборы миллиардных масштабов, общенациональный обман. Я как водитель с двадцатилетним стажем скажу, что бумажечка на стекле никоим образом не гарантирует исправность машины в течении двух лет. Поэтому я и предложил отменить этот техосмотр, водители будут отвечать за техническое состояние своей машины, и это будет, возможно, первый системный случай, пример снятия с государства взяткоемной функции. Я думаю, что законопроект в первом чтении будет принят».
Народный депутат Андрей Шкиль (фракция БЮТ): «Я убежден, что техосмотр должен быть, причем как государственный, так и частный. Техосмотр — это же не только осмотр и замена деталей, это гарантия того, что автомобиль определенное количество километров проедет нормально и без аварий, вернее, без тех поломок, которые могут стать причиной аварии, а это, в свою очередь, обеспечение гарантий безопасности на украинских дорогах. Я скажу, что необходимо введение альтернативы, я не люблю слово «только», техосмотр транспорта должен быть однозначно! Тем более, что совсем отменить технический осмотр нельзя, страховик должен знать, что транспорт исправный. Поэтому я считаю справедливым предоставить водителям альтернативу, оставив как государственный, так и частный техосмотр транспорта, обеспечив право самостоятельного выбора услуги».
